I. General Terms and Conditions

1. Scope of application
The General Terms and Conditions (hereinafter referred to as "GTC") apply to all orders placed and contracts concluded (hereinafter referred to as "Order") via the online store of Muntagnard AG (hereinafter referred to as "Muntagnard").

Muntagnard reserves the right to change the GTC. The version of the GTC in force at the time of the Order shall apply and may not be unilaterally modified for this Order.


2. Prices

The prices are in Swiss francs, including value added tax (VAT). The price in the online store at the time of the order is decisive.




3. Couchers & discounts

Coupons and discount codes are not cumulative with other coupons and discount codes and they are not valid for already discounted products and special offers. The validity period of a coupon code is communicated in each case when it is issued. If no specific expiration date is indicated on the coupon or discount code, it is valid for a maximum of 1 year (365 days) after receipt. All vouchers and discount codes are valid exclusively on www.muntagnard.ch.




4. Order

The presentation of the goods in the online store is not a legally binding application, but a non-binding online catalog or a non-binding invitation to the clientele to order the goods in the online store.

An order is considered an offer to Muntagnard to conclude a contract. After transmitting the order, the Customer will automatically receive a confirmation of receipt (or order confirmation), which documents that the order has been received by Muntagnard.

Muntagnard is free to reject orders in whole or in part without giving reasons. In this case, the customer will be informed and any payments already made will be refunded. Further claims are excluded, in particular there will be no forwarding of products that cannot be delivered.


5 Conclusion of contract

The contract is concluded only at the time of shipment of the goods.

Exception for pre-orders (e.g. for the Winter Community Mask): If a cancellation of the order is not requested within 7 days after receipt of the confirmation of receipt, the purchase contract is bindingly concluded after the expiry of this period.

 

6. payment

Credit card (Visa, Mastercard, American Express [...]), PayPal and Twint are accepted as means of payment. An invoice is currently only possible in exceptional cases and for large orders due to system technical reasons.

In the case of payment due to refunds, if there are outstanding claims from the customer, the refund will be made within 30 days to the account used at the time of purchase. The period begins with the receipt of the goods by Muntagnard.

7. deliveries within Switzerland

After receipt of payment, the ordered goods will be dispatched within 3-5 working days, unless the online store lists different delivery times.

Time deviations are possible, especially on peak days with exceptionally high delivery volume, whereby any claims for damages and other claims of the clientele are excluded.

At the time of delivery, the customer assumes responsibility for the delivered goods, even if they were not directly received by him.

The delivery costs depend on the value of the ordered goods and the country of destination. The delivery costs communicated in the online store apply. The delivery costs are listed as an additional item in the shopping cart and on the invoice.

8. deliveries abroad

Currently, international orders are delivered to some European countries. After payment of the order, Muntagnard will transfer the Swiss VAT of 7.7% back to the customer. Muntagnard has no control over the customs duties, local VAT or other fees incurred in the country of destination and cannot provide information on their amount as they vary from country to country.

All customs duties, VAT (with the exception of Swiss VAT) and fees in the country of destination are the responsibility of the customer and must be paid by the customer. It is recommended to check with the relevant customs office before placing an order to avoid unforeseen costs.

9. Right of revocation

The customer may revoke his contractual declaration within 14 days without giving reasons in writing (letter or e-mail) or by returning the goods.

The period begins after receipt of the goods by the buyer.

Exception for masks (Winter Community Mask): For hygienic reasons, the mask can not be exchanged/returned. Therefore, returns of this product are not possible after receipt.

Exception case pre-orders (Winter Community Mask): Only the pre-ordered quantity of masks will be produced to avoid overproduction. Thus, the purchase is binding after the deadline listed above. If a buyer still wants to withdraw from the purchase, as a gesture of goodwill, a voucher for the amount of the purchase for the online store, or a credit note for the amount (minus transaction and processing fees) will be offered.

Returned merchandise must arrive at Muntagnard unused and in perfect condition. If the Customer is unable to return the goods received in whole or in part or only in a deteriorated condition, the Customer may have to pay compensation to Muntagnard. Compensation for the value of the goods must only be paid if the goods have been used in a manner that goes beyond the examination of the characteristics and functionality of the goods. Testing the properties and functionality" is understood to mean testing and trying out the respective goods, such as is possible and customary in a retail store.

The timely dispatch of the revocation or the goods shall be sufficient to comply with the revocation period. The revocation is to be addressed to:

10 Applicable law and place of jurisdiction

The legal relationship between Muntagnard and the Customer shall be governed by Swiss substantive law, excluding conflict of laws rules and the Vienna Sales Convention.

The exclusive place of jurisdiction for disputes arising from or in connection with these GTC is Chur.

11 Severability clause

Should individual provisions of the contract, including these provisions, be or become invalid in whole or in part, or should the contract contain an unforeseen loophole, the validity of the remaining provisions or parts of such provisions shall remain unaffected. The invalid or missing provisions shall be replaced by the respective statutory provisions.

 

II. Competitions

1. competition conditions

This competition is organized by Muntagnard AG, Denter Tumas 6a, 7013 Domat/Ems, Switzerland.

All natural persons with permanent residence in Switzerland and the Principality of Liechtenstein are eligible to participate. Excluded from this are employees of Muntagnard AG and its contracted companies.

 

2. contest guidelines

The participant of the contest is the person who owns the e-mail address that was provided when registering for the contest. Only one participation per person is possible. Any irregular or repeated participation of a participant in the contest will result in his/her exclusion. Likewise, any automated participation or entry as well as any technical manipulation will inevitably lead to exclusion from the contest. Participation is free of charge and free of any obligation to purchase. Only the prizes described in more detail in the competition will be awarded. The prizes will only be awarded to participants who have personally completed all the entry fields required for participation in the competition in a complete, comprehensible and truthful manner. Muntagnard AG reserves the right to suspend the competition completely or temporarily if there is a suspicion that the integrity of the competition is at risk. The closing date for entries is indicated on the relevant competition medium.

Muntagnard AG also reserves the right to change these conditions of participation without notice. The consent of the participating person to the use of the transmitted data for further offers and information (advertising in the form of e-newsletters and/or mailings with current news and attractive offers), which is granted with the registration, is the entrance ticket to the competition. The data will be stored and processed within Switzerland and the Principality of Liechtenstein.

The transfer of data to third parties is excluded. If you no longer wish to receive offers and information from Muntagnard AG, you can contact us at any time at contact@muntagnard.ch or unsubscribe directly from the newsletter. Muntagnard AG undertakes to exercise the necessary care in handling personal data at all times and to comply with Swiss data protection regulations.


3. prizes

The winners will be contacted directly by Muntagnard AG. If the winner does not contact Muntagnard within 14 days after the prize notification has been published, Muntagnard is entitled to send the prize to someone else.

Winnings will not be paid out in cash or exchanged and can only be transferred to another winner by arrangement. The winner accepts any changes to the prizes. If the prize has been handed over to the post office, Muntagnard AG shall not be liable for any damage or loss incurred in connection with the delivery. No correspondence will be entered into about the competition. The legal process is excluded.
